2.  Previous information

The General Purchase Conditions regulate the distance selling relationship between the products offered by ROSE HILL on its website www.rosehill.io and the User, in accordance with the legal stipulations in force in distance selling, the General Law for the Defense of Consumers and Users, Data Protection, and Information Society and Electronic Commerce Services.

In this sense, the User must accept the General Purchase Conditions before placing the order, so before proceeding to accept it, read its content carefully. 

If you do not accept the General Purchase Conditions, the purchase of the products cannot be carried out and consequently ROSE HILL will not assume any type of obligation or responsibility. 

ROSE HILL reserves the right to modify the content and/or scope of the General Purchase Conditions at any time, without the need to communicate or notify it in advance, so, before purchasing the products from our Website, carefully read its content. It is the responsibility of the User to review the General Purchase Conditions before purchasing any product from the Website.

3.  Contract Celebration

It is an essential requirement that you register as a User of the website to be able to buy online. To do this, you can access the “User registration” section. 

Likewise, the User declares to have sufficient legal capacity to contract the products of the Website. 

During the purchase process you must identify yourself with the username and password provided. These data will not be public. You are responsible for treating confidentially and responsibly the identity and password obtained when registering as a User, and may not transfer them to another. You can modify the registered information at any time by going to the “User Area” section of the website.

In this same “User Area” section you will have access to a history of your orders. This is only a consultation section, but its management is allowed, and the user can delete those records that he considers not necessary to view.

Users can modify their personal data by accessing their “Profile” within their User account. Additionally, if the User has forgotten their password, they can recover their password in “Login”  “have you forgotten your password?”  “Recover”. 

Once the order has been placed, the User will receive an acknowledgment of receipt by email or other means of electronic communication equivalent to the address indicated.

5.  Product Availability

The availability of the products offered by ROSE HILL may vary depending on User demand. Although ROSE HILL updates the stock periodically, the product requested by the User could be out of stock at that time. In case of non-execution due to unavailability, the User will receive an informative email and in a maximum of 30 days the amounts paid for the canceled order will be paid.

6.  Price 

The price for each of the products will be the one that appears in euros along with each product on the Website and will include the applicable VAT that, if applicable, may apply.

ROSE HILL reserves the right to modify its prices at any time and without prior notice. The price applicable to the purchase request made by the User will be the one stated at the time of accepting the General Purchase Conditions. 

7.  Way to pay

The User may pay the amount of their order by choosing any of the following methods. During the purchasing process you must indicate your choice:

VISA or MASTERCARD credit card.

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Socked Layer) security technology. All information you transmit to us travels encrypted over the network.

Likewise, your credit card information is entered directly on the bank's website, at the POS (Bank's Point of Sale Terminal) and is not entered or registered on any ROSE HILL server.

When paying with a VISA or MASTERCARD card, you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD card. MASTERCARD, thus offering more guarantees about the security of the transaction.

When the amount of a purchase has been charged fraudulently or improperly using a payment card number, its owner may demand the immediate cancellation of the charge. In such case, the corresponding debit and recredit entries in the accounts of the supplier and the owner will be made as soon as possible. However, if the purchase had actually been made by the cardholder and the refund demand was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had unduly demanded the cancellation of the corresponding charge, it will remain obliged to ROSE HILL to compensate for the damages caused as a result of said cancellation.

PayPal

8.  Transportation expenses

ROSE HILL informs you:

  • Iberian Peninsula (includes Portugal): Free for purchases over €50. For smaller purchases the cost is €4.90
  • Balearic Islands: Free for purchases over €100. For smaller purchases the cost is €4.90
  • Canary Islands, Ceuta and Melilla: The shipping cost is €9.90. *Does not include customs fees or extraordinary taxes.
  • European Union: The cost of shipping to any EU country is €11.90.
  • European countries outside the EU: The shipping cost is €17.90. *Does not include customs fees or extraordinary taxes.
  • Rest of the world: Shipping costs to the rest of the world are calculated during checkout.

The transport of the articles from www.rosehill.io online is carried out by the transport companies MRW and GLS in the case of national orders and Portugal, in the case of international orders the transport companies in charge are DHL Parcel and GLS for Europe and DHL Express for the rest of the world. In no case will ROSE HILL be responsible for customs expenses or extraordinary taxes. 

9.  Execution and delivery times

ROSE HILL will ship products to the Iberian Peninsula, Balearic Islands, Canary Islands, European Union Countries, as well as to the rest of the countries. 

Once the User has made payment for the product, ROSE HILL has confirmed it, and the confirmation email has been sent to the User regarding their purchase, the products will be delivered.

The delivery of the order will be made to the address that the User has specified during the purchase process on the website - a PO Box or a Post Office will not be valid as an address -, and in no case will a change of address be accepted once once the order has been shipped. 

ROSE HILL will not be responsible for any errors that may occur in the delivery of the purchased products in the event that the User has not correctly filled out the delivery address. 

For orders placed within the peninsula and that do not belong to the "Premium" section or are Pre-sale (only Spain and Portugal), delivery times are 24 to 48 hours on business days. This period does not include Sundays or holidays.

If there is any incident in the delivery time, ROSE HILL will properly and immediately inform the User. The User will have to take into account that:

 Home deliveries are not made on Saturdays, Sundays and holidays.

 Deliveries are between 24 and 48 business hours, so on Saturdays, Sundays and holidays, deliveries and shipments are not made. If you have purchased with a 2x1 promotion or similar, your order may take a little longer, never exceeding 72 business hours.

 If you have purchased a pre-sale product together with another normal product, they will be sent to you all together within the deadline established on the same product page as the pre-sale.

 For orders placed to the Balearic Islands, delivery times are 48 to 72 business hours. 

 For orders placed to the rest of the European Union, delivery times are 1 to 7 working days. This period does not include Saturdays, Sundays or holidays.

 For orders to the rest of the world, delivery times are 5 to 10 business days. This period does not include Saturdays, Sundays or holidays.

If you need to adjust the delivery to your time needs, you just have to send an email to hello@rosehill.io as soon as you make the purchase. In the email you can indicate if you want the order to be delivered in the morning (8:30 a.m.-2:00 p.m.) or in the afternoon (2:00 p.m.-8:00 p.m.) from Monday to Friday. This option is only valid for purchases made in the Iberian Peninsula.

If you are absent during the delivery, the carrier will come by a second time and if on the second attempt you are still absent, he or she will contact you via SMS, phone call or contact email provided in the order to arrange a delivery or to Pick up the package at the nearest transport agency that makes the delivery.

Order Tracking

Once the order is shipped, the User will automatically receive an email or SMS with the tracking link to know the status of their order at any time. It is important to check the spam, promotions or junk mail folder of your email, since the email may be redirected to one of these folders by mistake. If you still do not receive the email, you can request the shipping number and tracking link through our email hello@rosehill.io

Failed shipments

ROSE HILL offers a free peninsular shipping service within 24 business hours, with up to two delivery attempts free of charge.

If delivery is unjustifiably rejected or delayed, we reserve the right to charge you the resulting storage costs and/or to terminate the contract. If so, we will pay the difference between the amount already paid and the reasonable administrative expenses that have arisen (including failed delivery and return of the Order, in addition to storage costs.

10.  Withdrawal

The User will have the right to withdraw from the contract, without any type of penalty, within a period of fourteen (14) calendar days from the date of receipt of the product.

To exercise the right of withdrawal you only have to complete and send this form to the email hello@rosehill.io

To proceed with the return, the product must not have been used and must be in perfect condition with the labels and the corresponding packaging (boxes, bags, etc.) in the same way in which they were received, to the following address: Calle Maria Ribes i Bertran 6, Mataró (Barcelona).

Once ROSE HILL receives the product and our staff verifies and determines that the return conditions are met, ROSE HILL will return to the User all payments received, including shipping costs within a maximum period of thirty (30) business days from of the date on which the User informs ROSE HILL of his decision to withdraw from this contract, if he has not received any product. In the event of a return, ROSE HILL will return all payments received to the User within thirty (30) business days from receipt and validation of the product. ROSE HILL will proceed to make the refund using the same payment method used by the User for the initial transaction, unless the User expresses otherwise. The User will assume the cost of returning the purchased product.

We remind you that the costs of returning the products will be your responsibility and that ROSE HILL will not accept returns sent postage due under any circumstances.

eleven.  Defective products

ROSE HILL guarantees that the product conforms to the characteristics indicated on the website and that it will be delivered in perfect condition. Likewise, the User must ensure that once they receive the order, they verify that it is in perfect condition. Remember that you have 15 calendar days from receiving the product at home to request a return. 

In the case of receiving a product in poor condition, the User must send an email to hello@rosehill.io. 

Once our staff verifies that the product is indeed defective, the money will be refunded or replaced.

A product will not be considered defective if more than 6 months have passed since it was received, since it cannot be determined if it has been used improperly.

For said return to be effective, you must ensure that the product:

 has not been used

 It has not been involved in any accident or been damaged while attempting to repair it.

 It has not been used contrary to what is established by the seller.

 It has not deteriorated due to wear, misuse or machine washing.

In the event of non-compliance with the above requirements, and if the withdrawal period has passed at the time of making the return, ROSE HILL may decide at its discretion whether or not to make the refund.

From the moment delivery occurs, the User will assume all risks that the product may suffer. ROSE HILL will not be responsible for what may happen to it once it is delivered in perfect condition.

Under no circumstances will a product be considered defective if it has been misused. It is not advisable to use our products for any type of sporting activity or to wash them in the machine as they may deteriorate or break. 12.  Complaints and Claims

ROSE HILL must respond to the claims received in the shortest possible time and in any case within a maximum period of one month from the presentation of the claim. 

In accordance with Regulation No. 524/2013 EU, the European Commission makes available to Consumers and Users an online dispute resolution platform, which is available at the following link: http://ec.europa.eu /consumers/odr/. Consumers will be able to submit their complaints through the online dispute resolution platform.

13.  Applicable law and jurisdiction

These General Contract Conditions will be governed and interpreted in accordance with Spanish legislation. 

Any disputes that may arise between ROSE HILL and the User must be settled in the Spanish Courts and Tribunals.

14. Gift Cards

Gift Cards cannot be used to purchase other Gift Cards and are not compatible with any type of discount or promotion. We reserve the right to cancel any order that does not meet the above purchase requirements.

15. Presale and Premium Products

Pre-sale products have a delivery date different from that stipulated in our shipping and returns section. This date can easily be found on the same product page, above the add to cart button.

ROSE HILL undertakes to send the package within a maximum period of 10 business days from the date indicated on said product.

Orders containing products from the Premium section cannot be canceled after 48 calendar hours from the date of the order. As they are made by hand on demand, a cancellation after 5 days would mean loss of money, time and materials.

Orders from the Premium section can only be canceled if they have not been delivered within 30 working days from the expected delivery date stipulated on the product sheet.

16. Giveaways

In the draws carried out by Instagram on the official ROSE HILL account (@rosehill) the winners are always chosen at random through the appsorteos.com website.

The conditions of the draws will be determined in the same Instagram post, as will the prizes.

Prizes in free product format provided by ROSE HILL will be new unless otherwise indicated. Technological prizes (Iphone, Macbook, etc.) provided by third parties will be reconditioned unless otherwise indicated and provided by PC Componentes.
